12 Hour Rule

Just read in our state union magazine that contract includes a "12 Hour Rule", and that mgmt can't work us over 12 hrs per day (regulars). That's all it says, nothing about recourse if it has happened or what to do if it's expected to happen.

I was on overburdened route June-Nov, worked 12 to13.5 hour days many times. Does anyone know about this?

-- Without having access to your state union magazine's article, consider this:

- Article 9.2.A.1.i. -- Any regular rural carrier compensated pursuant to FLSA Section 7(b)(2) SHALL receive overtime compensation set forth in paragraph k. below, for hours actually worked in excess of twelve ( 12 ) hours in any one work day or in excess of fifty-six ( 56 ) hours in any work week.

-- On the RCA side, there is Step 4 ( R-96 ) - in part: However, except in emergency situations, management MUST NOT schedule a leave replacement to serve on two full assignments or one full assignment and one or more partial assignments in a single day, IF the evaluations total twelve hours or more.

- Of course, even though the two assignments may not reach the 12-hour evaluation limit, there is no guarantee that the RCA will be able to complete the two assignments at or under the evaluation total.

-- To add to the confusion, there is the ELM's Section 432.32: Maximum Hours Allowed. EXCEPT as designated in labor agreements for bargaining unit employees or in EMERGENCY SITUATIONS as determined by the PMG ( or designee ), employees may not be required to work more than 12 hours in 1 service day. In addition, the total hours of daily service, including scheduled workhours, overtime, and mealtime, may not be extended over a period longer than 12 consecutive hours.

-- A couple of things to remember:

- Seems everything is an emergency to manglement
- City carriers have the OverTime Desired List which lets them work 12+ hours in a work day -- all year round -- while rural carriers just have the 3-weeks during the Christmas No-Overtime Period.

Those hours also add to the overtime for the weekly hours, over evaluation for the regular during the Christmas season, or over 56 in the week for the rest of the year. An Rca gets overtime for all hours over 12/40.
What you may be thinking of is, that an RCA MAY NOT be scheduled for any other hours that would go past 12.
For example: an Rca runs a 9 hour route, he can not be scheduled to "help" on more than 1/3 of another 9 hour route, because that would be scheduling on more than 12 evaluated hours.

Is it not automatic in the payroll system; or does the supervisor need to know how to input this? I'm pretty sure I was not paid any extra, but I will check my stubs. Thx.

Definitely accurate.

We have folks exceed 12 hours regularly, then beyond that OT is paid. But, from reading here, its obvious that a lot of rurals work over 12 hours regularly.

Our POOM would rather people not work over 12 hours, but only because of the OT. Won't OK help for them, typically.
