120 day Letter question

Green

New member
So I went full time back in March. I have yet to get my relief day off. I have an RCA assigned to my route as a sub, however the PM won't allow me to take a day off until we get a second RCA. My sub does a 5 hr route and would not be able to do mine also. I have the feeling I am in for a long wait here....

Is filing a 120 day letter even an option since I technically have a sub? Is there anything I can do in this situation? Thanks!

If your 4240 shows a 'sub of record' name in the substitute position, then no, you can't request a sub for the route because it already has one assigned. Harp on mgmt. and get the subs to whine often about needing more help, that seems to move them sometimes.

How long is your route, @Green?

Additionally, it seems that your sub carries an aux, no? Technically, he/she is to carry your route 1st. The PM can suit up and carry the aux.

You definitely have a grievance, IMESHO.

My route is 9.2 hours. He carries a 5 hr aux everyday and there is also a 2 hr aux tossed into the mix. He does both (7 hours) and I do mine everyday.

File a grievance every time you are forced to work your relief day.

Every time.
Someone told me that if I made a stink, the PM said my relief day of Saturday would be changed. The PM did not say this to my face but it was said to someone else who then told me. That is something I would not like, but as time goes by I like the idea of filing more and more. Would there be a way to change it back someday?

Due to you being unable to get into 2240 trouble during your partial guaranteed year you will most likely not see relief until next year. File a grievance. Next year you will be monitored closer, you & your PM will be held more accountable. If you are not already on the RDWL, sign up in October and always take Daca 5, after working 11 relief days you will be in 2240 trouble and should never have to work another relief day.

Please contact your union rep. And I hope this doesn't sound too harsh, but you're getting NO RELIEF DAY now, and you're worried about them changing the RELIEF DAY YOU DON'T GET to another day (which they won't give you off either, btw).

They're perfectly happy with us working six days a week, 52 weeks a year.

File the grievance. They can't change your relief day without your permission or unless the office goes formula. Right now they have absolutely no incentive to hire an RCA as long as you're too scared of "making a stink." Why would they? Hiring and training an RCA costs them money and aggravation; easier to just let you work until you drop.

This is a fantastic post by someone who knows her stuff.

Remember, if you file a grievance every time you're forced to work your relief day, part of the
process is that your lazy, insensitive, entitled PM will have to show they tried to get coverage
for every date you file on!.
That's huge!.

Each grievance will prove your PM is not doing all necessary to get you relief.(
Gee, I hope you ask for progressive monetary penalties!)

your not getting a relief day, and your worried that they may change your relief day to a day that you can have off? if your not getting saturday off, you don't have a relief day. i mutually agreed with the pm to change my relief day to monday, and if i could now have saturday, i'd fight to keep monday.

but the kicker is, if you switch to a different day, by mutual agreement, anytime you decide you don't like it, the agreement is broken, and you get saturday back. does no good till they hire an rca, however...

It seems that the lone sub in the office works two auxes each day ("He carries a 5 hr aux everyday and there is also a 2 hr aux tossed into the mix. He does both (7 hours) and I do mine everyday.") so even if the OP agrees to switch relief days, there is no one to work that new relief day. So what sort of threat is the PM making? "You better not file a grievance! You think you don't like not getting Saturdays off? I'll show you! I'm going to switch your relief day to Tuesday and we'll see how you like not getting Tuesdays off!"

And again, the PM cannot unilaterally change a carrier's relief day. I had a grievance where the carrier won a huge settlement when a PM did this (the carrier got paid for 7 months of OT that they should have earned). The carrier just needs to be brave, contact the union rep, and this situation will be resolved in the carrier's favor. They'll find coverage or they'll hire another RCA.
