How many hours can an RCA be scheduled to work in one day?

Surprise!

How many hours can an RCA be scheduled to work in one day?

I thought someone posted that substitutes can only be scheduled for 12 hours a day, is this true?

Yesterday we had RCA's scheduled for 18 hours evaluated and I know that some worked at least 14 hours.

I am told that this is a common occurrence.

I was also told that grievances were filed but that the substitutes were paid so that ended it. If this is winnable, I thought that part of a settlement would be that Management can't do it again. However, I don't know that this is winnable.

Contact says not scheduled more than 12 hours. "Scheduled" is a funny term. Manglement will say they didn't schedule it but you still need to do it.

However ELM  says they cannot require an employee to work over 12 hours and that includes lunch or breaks.

Acknowledgement that manglement was wrong and a cease and desist are what you are looking for.

Surprise! -- "I thought someone posted that substitutes can only be scheduled for 12 hours a day, is this true?"

-- Yes, it is true.  Step 4 ( R-96 ) in part -- However, except in emergency situations, management MUST NOT schedule a leaver replacement to serve on two full assignments or one full assignment and one or more partial assignments in a single day, if the evaluations of these assignments total twelve hours or more.

--  ELM 432.32 -- Maximum Hours Allowed.  Except as designated in labor agreements for bargaining unit employees or in emergency situations as determined by the postmaster general ( or designee ), employees MAY NOT BE REQUIRED to work more than 12 hours in 1 service day.  In addition, the total hours of daily service, including scheduled workhours, overtime, and mealtime, MAY NOT EXTEND over a period longer than 12 consecutive hours.   Postmasters and exempt employees are excluded from these provisions.

--  A couple of flies in the ointment:

a.  while the scheduling may be limited to less than 12 hours, there is not guarantee that the carrier will get the work done in under 12 hours.

b.  Page 3 of the current contract:  emergency situations -- i.e. an unforeseen circumstance or a combination of circumstances which call for immediate action in a situation which is not expected to be of a recurring nature.  Not necessarily the definition manglement adheres to.

"I was also told that grievances were filed but that the substitutes were paid so that ended it."

-- If you have a BS flag, toss it!!   Ask manglement for that reference - politely or otherwise.

To add to "Deer Smearer's" "cease and desist", add "monetary penalties for further violations" in the settlement.

We were told the manglement has to report to District any work hours over 12.   18 work hours in a day will hopefully catch someone's notice at District, and if not there, then at Eagan.

As with any grievance the way to get a change in the way things were done is to make the USPS pay $. The RCA's in the case you mentioned were paid correctly for hourly work but they worked over 12, so that time is 150% pay. If there are any regulars that have signed the RDWL?  If so, they also have $ sitting on the table for the next 14 days. If an RCA worked more than 12 hours the regular on the RDWL should have worked and therefore should file for 150% of their day's pay. When the USPS pays $ out things change, but being on the RDWL I have always found it beneficial to be paid 150% to "have the day off" while I sit at home.
