Is it grieve-able?

A few weeks back our PM announced that all RCAs were no longer allowed to case DPS (still fine for regulars to do so)and that this new rule was not coming from him, but from the district manager. Now, I am ok taking DPS to the street in an LLV, but when I am in my POV it really slows me down as I only have room for one tray of mail in my front seat, so I pretty much end up casing the mail while scrunched in my car. Since I started taking DPS to the street, I rarely make my evaluated time anymore - which wouldn't bother me if was allowed to work the 40+ hours a week I had been, but now there is also district-wide ban on RCA overtime and they are sending RCAs home as soon as they hit 39 hours (grieve-able too?). So, I am wondering how I would grieve the forced DPS to the street since it is not coming from within my office but from district and since it is not route specific or a issue of individual circumstances. Any guidance or advice would be greatly appreciated!

Grieve both separately, with a make whole clause, especially for any hours lost on primary route assignment that were under the routes evaluation that you were guaranteed. A cease and desist clause should also be included, as well as a reference to not having this mandate happen again. Sounds like district is mighty full of themselves lately where you are.

You need to let your steward know about the problems in your office, because your pm "resolving" your problem with losing time due to his "non-contractual" order, is affecting all of the rca's.

First, any rca that works on their primary route , all week, is guaranteed to work the evaluation of that route, not only 40 hours, and that includes overtime. If a pm wants to work an rca up to 40 hours but not over, they may, if that rca has not earned those hours on their primary route. If an rca has worked 39 hours in 4 days on routes other than their primary, the pm is "required" to work that rca (according to the matrix) on the next day for not just one hour, but two. The reason is , even though it is into overtime, all rca's scheduled to work, on any given day, must work at least two hours, and the rca in this scenario had to be worked up to 40 hours, because the matrix guarantees work on that route by that rca up to 40 hours and never any less than 40 if more work hours were needed on that route.

DPS to the street, is never "blanket required", and can be "required" only on a case by case basis, (with proof) if the pm determines it to be "helpful" to the USPS. Your manager was the manager that gave you the order, and therefore is the person you file your grievance with, if your manager thought (correctly) the order was non-contractual, then he shouldn't have given it. The error in the order given, resides directly with your pm, no matter where "he says" the order came from.

You have surpassed the 14 days needed to file a grievance, but because this is an ongoing "order" you can still file, but the money that can be sought would be only for the 14 days before the grievance.

cstan -- Along with "Shafted"'s suggestions, add "monetary penalty for repeated offenses" or words to the effect. A favorite on city side grievances.

-- Always keep the Assistant District Representative informed when manglement ( local and district ) does such ( stupid ) things.

-- Look up Step 4 ( C-14 ), the "Galligan Letter" from 26 NOV 2003. Although aimed at the Christmas Period, it should be good all year round.

File a grievance for disparate treatment if they are letting regulars case mail but not subs. They tried that crap in my office too we filed a grievance and won. Then when that didn't work they got on us about "daily evaluations" which there is no such thing of. Also I thought I saw somewhere that if you are using a pov you do have the right to case some of your mail as long as it doesn't affect your time out on the street maybe someone with more experience can elaborate?

For the ban on overtime I'm not sure of an answer, in my office we don't have enough help and can't keep it to prevent the subs from going into overtime, every year they have a meeting about it and we always stand there and roll our eyes. This year my boss got on me about being in overtime with "daily evaluations" crap. I more or less told him to piss off and that if I was in overtime it was his fault. It had gotten to the point where I would tell him that scheduling me for such day would put me into x number of hours of overtime, after awhile he just left me alone lol.

I can tell you that if you are an rca and that if you go into overtime on your primary route that there is nothing they can do, you are entitled to those hours as the primary sub to the route.
