Jury Duty and Pay

Forgive me for bringing up a subject that has already been discussed. I did a search and found answers . . . .sort of. I'm an RCA and according to the information here, an RCA receives no pay for jury duty (I'm an aux route, designation 79). My postmaster and one of the supervisors both thought RCAs received partial pay. Someone said to check your 3971, but I'm not sure what the 3971 is? Can someone point me in the direction of where it is stated that an RCA receives no pay or partial pay? My PM is on my side with this due to carrier shortages and knowing any day missed is truly a hardship for me. I'm scraping by just barely.

I know of RCAs that told the court they could not financially afford jury duty, because of the way RCA pay is set up.... and they were excused....

We had a CLERK that the PM wrote a letter for, to get excused, and the court turned them down, and they had to sit for jury duty....

Have you asked the court to be excused due to finances???? Also, PM could write a letter.... might help, might not....

I got paid for 3 weeks of jury duty, but, I'm a Reg carrier....

Good luck.... (y)

Btw, 3971 is a leave slip.... on the back, there is a jury duty block to check.... however, I'm not sure what the rule is for RCAs getting to use jury duty admin leave.... hopefully @gotstamps or some other smarter person here will know....

-- As an RCA, you are not eligible for Count Leave and must use annual or LWOP to cover the time at court. ( ELM Section 516.22 )

-- The USPS won't be paying you, BUT the Court will have some stipend for your service. ( ELM Section 516.22 )

-- Carriers eligible for Court Leave can refuse the Court's stipend and retain their USPS daily pay.

-- While the court giveth, the USP taketh away! Employees may retain any court allowance in the amount of $25 or LESS per day on days court leave is authorized. ( by letting you attend to court duties, that is USPS's approval of you having "court leave" -- IMHO ) Employees must remit to their supervisor amounts received in excess of $25 per day. ( ELM Section 516.41. GET A RECEIPT if you do!! )

-- Or the supervisor could look the other way. Who knows? Just don't tell the super of Section 526.41! )

-- Going for something off the wall: The PM supervisor may [ or may not ] try a letter to the court saying your absence would contribute to the current headline making news of the USPS delaying mail. ( but don't count on it working )

-- Just hope the court is not requesting jurors for Grand Jury duty.

When I was on jury duty.... several potential jurors stood up during jury selection and explained they could not afford to lose pay during jury duty, and as far as I recall, they were all excused.... most were peeps that didn't get paid if they didn't go to work....

Thank you both. The simple answer then is the USPS does not pay an RCA their regular salary when they are on jury duty. Got it. That's all I needed to know. And a letter of financial hardship is happening because it's true! All these people collecting unemployment plus that extra $600. Let them serve. I need to work!

The court may still require you to show up for jury selection procedings.... that's usually where the judge will ask all the potential jurors if they have any conflicts that would prevent their serving.... some lady told the judge she had 2 young children and no babysitter.... she was excused.... pretty much everybody who had a reasonable reason, was excused.... :)

as soon as the defense attorney see's you might be bitter, angry or anxious they don't want you.. 79's and leave earning rca' get jury pay?

stillfirstclass -- "79's and leave earning rca' get jury pay?"

-- Yes -- but from the court, not the USPS.

-- Regular and PTF carriers retain their USPS pay. Section 351 of the ELM.

From my experience, the court pretty much was willing to excuse anybody who didn't want to be there, as long as they gave some sort of reasonable sounding excuse.... and not getting paid, and financial hardship seemed to be the most common reason cited.... :)

my postmaster wote me an excuse saying i couldnt financially afford time off. i was still denied. i wasnt choosen though. two days i was there i slept through all of it. then i was excused:sneaky:

Well we don't get holiday pay, so . . . . Can't see why they'd give us jury pay.

And btw, the court pays $10 a day.
I was paid $15 to show up at the County Courthouse with about 200 others for initial meet up to select for 6 cases. All 6 were plea bargained that morning and we were released and given 3 five dollar bills out the door. There were 3 tables in the hallway soliciting donations for different causes...what a gimmick. Many forked over...I used mine to fork pancakes at IHOP.

I just came across as a nut job and they didn't want me! Coming across as a nut job is easy for some of us. Right DB!?
