PM at it Again

Ok folks, need help as usual. We had a carrier that was attacked by dogs.The PM goes out and takes a photo of her injuries. Keep in mind that NOONE ELSE took pictures. Now, some in our office has this photo on their phones showing it around.Is there not a law against this? The DR told her she could file a grievance. I think more needs to be done. What do you'all think??? Thanks so much in advance for any and all help!
 
Rt2Mailman -- "Did the dog bite your friend on her butt? If your pm took those pictures , and shared them, he's in big trouble."

-- The PM probably is in big trouble, not matter where the carrier was bitten.

-- The photo could be considered evidence in a court case. But since the photos are out there, the photos probably would be inadmissible in any court case.

-- "peggymailady" try to make a list of the office personnel who have the pictures on their phones - for future reference.

Absolutely no way I could or would work in this office/atmosphere.

Worse it has been 25 years. We have filed numerous grievances. As my mama would of said, these grievances aren't worth a hill of beans!!!Completely useless. We have won all of the grievances against this monster. Noone makes sure that he follows through. Don't think you can fire a PM, he is immortal and above all human laws. Just hoping the Devil makes him pay at the end. I am not a mean person,but I am getting there!

HIPAA generally does not apply in these situations, as USPS is neither a healthcare related business, nor does it generally provide medical care to injured employees.
While I agree HIPAA does not apply, there are some protections for workers in the Americans with Disabilities Act that prevents an employer from discussing an employees medical condition. Not sure if the issue here would qualify as a disability, though (I haven’t read the entire thread).

the steward is responsible for making sure that the settlements are complied with. if they are not, then noncompliance grievances need to be filed.

a PM can be fired, just like the rest of us. what he did was illegal, against HIPPA, and the carrier may want to pursue that angle. calling congress people is also effective.
 
HIPAA definitely doesn’t apply here . But it has to be some kind of violation of something. It definitely was not a decent thing to do . To hold him liable , like few others I would suggest a consultation with a lawyer
