RCA awarded route with greivance filed over bid proceedure pay

Long story.. short version... Routes come up for bid. Route awarded to most senior RCA in APO wins bid. RCA with more seniority in RMPO claims they were unaware of bid so grievance submitted by them even though bid posted in RMPO. So award now in limbo.

RCA who won bid is serving a 40J. Ran route first week in 40.50 in 6 days. Ran route 2nd week in 5 days at 36 for week. Management paid them by the hour for both weeks.

Is this correct? The feeble knowledge I can recall is,  if you ran as a newbie/RCA/hold down and stayed under 40 for the week one was paid full Eval.  Since this carrier ran over 40 in week one going over Eval and being paid correctly and stayed under 40 Eval the 2nd week do they have a grievance?

Isn't it the carriers choice on a new route award to be paid EVAL or hourly?

If the carrier working the route is thought to have won the bid, they're paid as a regular to that route. If the bid is reversed (which they rarely ever are)  that carrier will have to pay back any excess moneys.

Yes.

Yes.

Where can I cite for this RCA if this is the case of being paid incorrectly? The local STEW and ADR have personal issues with this carrier along with them being a non member for now.

Faceindawind --  "Isn’t it the carriers choice on a new route award to be paid EVAL or hourly? "

--  On a new route? -- not exactly.  However - comma - when an RCA makes regular, he/she has an option to be paid hourly until the start of the new Guarantee Year.   Covered on pages 8 and 9 of the new contract.

--  When did the RCA make regular?  If it was before 14 OCT 17 - the hourly pay option would be short-lived.

"The local STEW and ADR have personal issues with this carrier along with them being a non member for now. "

--  Whether the new regular is a union member or not is a non-issue when it comes to be represented by the local steward and ADR as they have to represent everyone.  If the offending member does not feel the steward and / or ADR are representing him/her fairly, the issue could end up in front of the National Labor Relations Board for non-representation. ( not a pleasant thing for all concerned )

"RCA who won bid is serving a 40J. Ran route first week in 40.50 in 6 days. Ran route 2nd week in 5 days at 36 for week. Management paid them by the hour for both weeks. "

--  The RCA who won the bid is now a regular carrier ( even if the bid is in limbo ).   Regular carriers get paid the route's evaluation and not hourly.

"Routes come up for bid. Route awarded to most senior RCA in APO wins bid. RCA with more seniority in RMPO claims they were unaware of bid so grievance submitted by them even though bid posted in RMPO. So award now in limbo."

--  With the bid posted in the RMPO, don't think there is much to grieve, aside from missing out on the opportunity to make regular.   It is not manglement's responsibility to announce that bids have been posted, they just have to post the bid.  Usually word gets through the "grape vine" that so and so is retiring and the route will be going up for bids.  Bids should be posted in a regular place in the office and it is the RCA's and regular carrier's responsibility to check the postings regularly.

--  Page 24-25 of the new contract covers posting --  When a rural route becomes vacant, it shall be posted within thirty ( 30 ) days from the time it becomes vacant, except.... ( nothing about manglement having to announce it -- although it would be nice to do it during a stand-up )

Keep in mind, no one has been paid in the new guarantee year. The year started October 14th. First paycheck for the new year is November 3rd.

Thanks for input. Had Friday after work Soda Pops with them today. Upon further discussions this is what I found out to add to the tale.

In this APO/RMPO a route went up for bid. Route was awarded to most senior RCA in APO. An RCA in RMPO with more seniority than APO RCA filed they were not notified of bid.  RCA from APO who won bid files too on the basis it was posted.  While this is going on the RCA from APO who won bid for this office, bid and won another route from a district wide posting within 3 weeks of original award to another office. Meanwhile back at the APO bid reposted due to grievance. RMPO RCA carrier who filed wins bid for route they filed over. RCA from APO who won original bid has moved onto another office with larger route. RCA who won original bid claims they can't withdraw the grievance they filed because it has moved up to a step 4. Their REP refuses to let go of this issue in order to settle future problems.

The RCA who is next in line to win award in this instance when it goes back to posting has been covering this route for 9 weeks now. Is being paid as an RCA in a long term coverage situation now. Their pay from my original post still a wonky issue? Gave this RCA another REP # to call outside of our area to ask.

My office just went through a similar situation where RMPO carriers were not notified of bids. The bid was reposted in all offices involved and all carriers under our "umbrella" had to sign off on bid posting. Guess what? 2nd posting awarded correctly. PM from my APO will do this from now on. Result.. all happy.
