RCA out past evaluated time

I am an RCA. We start at 8. My evaluated time to return is close to 4:30. Let's say you have to stand around and do nothing for an hour and a half because you are waiting for clerks to finish throwing packages. They are supposed to be done throwing at 8:30, but they are not done until 10:40. It is Monday, fyi. So, that makes you late leaving, which will get you back past your evaluated time. Yes, you got paid for standing around, but there is no pay past 4:30. So, you are working and not getting paid for it, right? And, you could have been done by 4:30, instead you are out late on your own time working. Is this ok, or does anyone else see this is as wrong? Remember, I'm RCA. I don't get the rest of the week to balance out my lost time.

You put your time on the 4240 for your start and end tour. Note that you waited in the comments section.

You also enter the wait time on a ps1234 (green card)

If you don't exceed 40 hours for the week you get paid for the route's evaluated time PLUS the wait time.

For example...

A 40K is 8.0 hours a day. If you spend 7 hours actually working on the route, and spend 1.5 hours waiting you get paid for 9.5 hours. (8.0 + 1.5).

Same route...

You spend 10 hours actually working on the route, and spend 1.5 hours waiting. You get the same 9.5 hours pay.

Anything not included in the routes evaluation is extra.

As Deer Smearer said, wait time goes on a green card plus is noted on the 4240.

I am guessing that you are a fairly new RCA. For the first five pay periods, you are paid hourly. If you're beyond the first five pay periods, welcome to the wonderful world of evaluated pay. I don't mean to sound harsh, but that's how our pay works. Sometimes you're way under evaluation and sometimes you're way over evaluation.

Orange -- Document, document, document. Use the "REMARKS" section of the 4240 to note when clerks finished parcels.

-- My old office used to have signs over each area noting the time when parcels, the Hot Case, flats, etc should be done.

-- Those signs gradually "disappeared" as the clerks were unable to finish at the posted times.

Management said that people were casing their DPS while others waited for the clerks to be done throwing, so I think they were implying that there was no wait time.

That is a personal decision (to case DPS).

Management cannot require to you to case it to avoid paying wait time.

Does the green card after evaluated time rule apply to Monday's? We get our Amazon late, which causes delays. Thank you to those who have replied.☺️

Anything you do that was not included in the route evaluation is extra. For example, casing screwed up dps, waiting for mail, deviation for express, assisting others, LLV breakdowns, certain service talks, SPMs (eventually) etc. Some are based on the actual time spent, others based on a formula.

If you work over 40 hours for the week then it's all paid on an hourly basis with OT for those hours over 40.

:O I didn't know I should have been recording deviations for express on a green card! Dang!!! I've done that so many times for free now! :( Sure glad I read this post so I won't be doing that for free anymore!

Can they make you go on a break or make you do other duties, such as Redbook or labels instead of paying waiting time?

Rebook or labels, yes.

Break, not a chance.

However, I would add that if you keep up with such things on a weekly or even a daily basis, then eventually "they" will have no choice but to pay you...or light a fire under the clerks' behinds...or get the trucks there on time...or correct whatever the hold up may be.

Make 'em pay.

shyflyrebelguy et al -- "Can they make you go on a break or make you do other duties, such as Redbook or labels instead of paying waiting time?"

-- As Deer Smearer posted, Redbook or labels, yes. Take a break -- no way.

-- Check out Step 4 ( W-9 ) for some guidance on waiting time and compensation:

The parties agree that when a rural carrier is required to wait for mail due to late arriving transportation, appropriate compensation will be provided. Waiting time will not be compensated until all carrier duties are completed, to the extent possible, including casing of all available mail.

When a carrier is required to wait for only DPS letter mail or other mail that does not require casing, including, but not limited to, parcels or boxholders, has no other rural carrier duties to perform, including the strapping out of all cased mail and is prepared to depart the office to effect delivery, the carrier will be compensated for the time the carrier is required to wait.

Compensation in both instances above would be in the form of auxiliary assistance equivalent to the waiting time, or by utilizing Form 8127 for regular rural carriers. Compensation for leave replacements would be made utilizing Form 1314-A or by providing auxiliary assistance.

-- As a bonus reference, M-38 ( Management of Rural Delivery Services ), Section 332.32.c: Under no circumstances should a rural carrier's schedule require or allow that the carrier wait for mail to be distributed during the morning or afternoon office time.

As detailed above, put any time not included in the evaluation on a green card. This includes, but is not limited to, second trips, deviations, waiting time, and broken down LLVs. Basically, if it's not included in the evaluation and it's not your fault, you get paid.

Revisiting this question: could management tell you to come in an hour later, start at 9 instead of 8, rather than pay you for waiting?

Orange -- "Revisiting this question: could management tell you to come in an hour later, start at 9 instead of 8, rather than pay you for waiting?"

-- Sure manglement could, do it as directed -- preferably getting the order in writing, then grieve it.

-- Page 31 of the PO-603 ( SEP 2013 ), Section 211 -- Report to the office as scheduled. ( That would be the time listed on the 4240 ).

-- Page 7 of the PO-603, Section 153.3 - Management may schedule you, or you may request, to report earlier on days when the mail volume is greater than normal in order to maintain regularly scheduled leaving time.

-- M-38 ( Management of Rural Delivery Services ), Section 332.32.c: Under no circumstances should a rural carrier’s schedule require or allow that the carrier wait for mail to be distributed during the morning or afternoon office time.

-- Page 45 of the current contract, G. Scheduling: The rural carrier will receive reasonable advance notice when the schedule is to be changed. ( pretty sure "reasonable" does not mean less than 24 hours )

-- Page 3 of the current contract, Article 8 - Hours of Work, Section 2 - Work Schedules. Daily schedules shall be established to coincide with the daily evaluation of the route and adjusted periodically as required. ( "periodically" was not meant to be on a daily basis )

-- Have yet to find anything in writing allowing manglement to order carriers to report later than the 4240's "Reports" Time for the purpose of avoiding paying for carriers to wait on mail. With possible exception to the occurrence of a natural- or man-made disaster that would disrupt the usual flow of mail for a number of days, which might be inferred in Article 3 -- Management's Rights.
