New rural regular approaching 2240 hours: Is management responsible for continued scheduling?
I’m a regular rural carrier trying to understand the 2080/2240 issue before the guarantee year ends.
- I have already exceeded 2080 actual work hours.
- I’m on the Overtime Desired List
- Management continues to schedule me and has not instructed me to take leave or reduce my hours.
I understand that exceeding 2240 hours may trigger an FLSA recalculation and potentially a Letter of Demand. My specific question is:
If management knows I’m approaching 2240 and continues scheduling me, rather than reducing my hours or having me take leave, can the Postal Service later issue a Letter of Demand requiring me to repay money?
I contacted my union representative several days ago but have not received a response.
For anyone who has dealt with this:
- Did you receive a Letter of Demand?
- Did you have to repay anything?
- If management continued scheduling you after knowing you were approaching 2240, did the union get the debt waived?
- Is management required to meet with you and make a plan to reduce your hours?
- Does being on the ODL affect the situation?
- What should I document now?
