Acts of God....Auxie Carrier

Scheduled to work tomorrow...........Flooded out. The PM ....although many parts of the Route are perfectly dry and easy to get to on a State Highway.....about 2/3rds of the route would be ok to deliver. .....told this Auxie Carrier....report to duty...... scan parcels as held at PO, put mail in case and then go out with the other RCA to help on a route that wasn't affected by the flood at all. PM told Auxie she wouldn't be paying EMA for the day. I am tossing the BS towel into the ring. And you can bet your last dollar the Regular on this flooded Route isn't taking any economic hit because of the flood.

I have read the Contract and it isn't real clear.......what do you all say.....

-- By telling the AUX carrier NOT to deliver the route, the PM really knows how to mess things up!! And apparently is not familiar with the route in question.

-- Normally an "Act of God" as defined by the F-21 ( Time and Attendance hand book ) is Section 582.31 -- An Act of God involves community disasters such as fire, flood, or storms. The disaster situations must be general rather than personal in scope and impact, and must prevent groups of employees from working or reporting to work. No doubt manglement will say the situation is not an Act of God.

-- However a recent Step 4 ( Q10R-4Q-C 16106590 ) ( 28 FEB 2019 ) sort of muddies the waters, as it were, because it deals with a regular carrier relief day. It reads in part:

The parties agree if a rural carrier reports to work on the relief day, but is not able to complete their normal duties due to an Act of God, a full day's compensation if provided, to include equipment allowance, if applicable.

-- Might have to get the office steward or Assistant District Representative involved as the AUX carrier should grieve for "desperate" treatment if regular carriers get EMA while the AUX does not. ( IMHO ) Moving on...

-- If PM still balks on EMA payment, cite:

-- Section 142.12.c of the PO-603 -- Exceptions ( of EMA ): Deductions are made from your salary or EMA for each scheduled day on which no service is rendered. EXCEPTION: NO DEDUCTION is made IF, after your reported at the Post Office, it is found to be impossible to serve ALL OR ANY PART of your route because of weather and road conditions. ( no mention of an "Act of God" )

-- At the least should get EMA for providing assistance on the other unaffected route.

If 2/3rds is able to be delivered, then deliver it. For parcels on the affected area, scan weather delay, then hold. For mail brought back, bundle and endorse "road not passable".

Duh.

PMs = StupidRUs.

(I'm sure for those affected the last thing on their mind is the latest circular from Kohl's.)

Thank you btdtret.......Do you see why it isn't clear ....the language isn't CLEAR.......Under Contract Article 30.1 H Acts of God....the Contract says "the Employer MAY authorize administrative leave, EMA will be paid for each service day a rural carrier reports to the post office and is scheduled to perform delivery.

Thank you...Oi veh. ......Couldn't believe they were not delivering what was up on the hills..........and perfectly dry..........the affected area is a small portion of the total route. I can't see how it is more safe to have almost 500 households coming into a neighboring PO to get their mail or having one carrier deliver. It is all very strange.

callofthewild -- just a follow up to previous posting.

-- Have the AUX carrier request the PM write a note to each resident explaining that it was he/she who ordered the AUX carrier not to deliver any mail on route.

-- Or have the AUX carrier give every customer the PM's post office phone number -- not the 1-800-(who cares) phone number.

-- Or have a call made to the Postal Inspectors regarding the delaying of mail.

.Auxie Carrier called and told me what she did on her scheduled day at work ..........her regular job....a 48K 130 something mile route. About 1/3 of this route is flooded out so the PM told her to come in scan parcels to hold...don't touch anything else... leave it for the Regular.

Her duties for Saturday May 25th.........came in scanned parcels to hold on partly flooded route.........helped run her Auxie Route (her 5 of her 5/1)....then the Clerk ask her to help box out mail.......because clerk wanted a short day. Left about 10:30.....

Let me see how many Contract violations can I count??? Mercy this is so bad ...I don't think I have enough fingers to count on. But, the worst thing is the delaying the mail on the partly flooded route.........talk about NO effort............to get to the 2/3rds of the route that isn't flooded would take about a three mile detour........which I have done many many times.........guess this is the New Post Office.

Last winter no office drops for 2 days from plant due to weather down state. We were never called to not show up. We showed up for those days and were instructed to take what was in house and caught up on some safety vids and talks. Those 2 days took about 3 hrs daily of my time. Got full EVAL. The Cityside had to deliver and stay the 8 if they did not want to burn awarded time.

A clear indication that most roads were passable was the line of people coming into the Post Office to pick up their mail.....there is a blue box on this route and it wasn't picked up for at least 4 days.........

Forgot to mention.....PM came over to Auxie Carrier today and ask her why she wrote down everything she did and didn't do on the 4240 (timesheet) for this past Saturday........PM said "are you trying to get me in trouble for falsifying the time sheet"? Auxie Carrier said "No, just didn't want to forget what I did Saturday".........this gets stranger by the minute.

Call the OIG I don’t know how u get their number but if u want the number to the one here in ga I’ll give it to u and she can get u a better number! Enough is enough!

So it got stranger....this is a RPO (Remote Post Office) one route office under the Mother Ship which is across the flooded river......the routes in the non flooded Post Office were not affected....not one box............someone must have lied big time to the POOM for her to go for this............the carrier who didn't attempt to deliver her route......even though at least 2/3rds could have been delivered...........HELPED DELIVER A ROUTE IN THE NON FLOODED OFFICE...........so how does that get entered into the pay system?? Nothing wrong with the carrier she helped.....nothing wrong with her POV....just helped the carrier have a short day............and this carrier also left the DATED boxholders for her RCA to carry Saturday..........wrong on so many levels........
