Emergency replacement

so I can’t work tomorrow but the postmaster decided that everyone needs to under threat of putting us on “emergency replacement” ie fired on the spot if we don’t come in.  I’m not working and frankly it’s not worth giving up Christmas for an 8-hour a week job with no benefits that we’re expected to plan our life around every day but my understanding is that any disciplinary discussions have to be with union representation so can a RCA really be fired on the spot with no disciplinary history in the 3 years working there

Call in sick on the 800 number... 1-800-cover-your-@$$  <img title="Surprised" alt="Surprised" src="https://www.ruralmailtalk.ruralinfo.net/wp-content/sp-resources/forum-smileys/sf-surprised.gif" />

Really it's 1-877-477-3273... and get the reference number that they should give you...    <img title="Wink" alt="Wink" src="https://www.ruralmailtalk.ruralinfo.net/wp-content/sp-resources/forum-smileys/sf-wink.gif" />

Don't go in.  This shit is getting ridiculous.  Call the unscheduled leave number and call in sick.  You can be a victim, or not.  Choice is yours.  Discipline is progressive on nature.  Unless you call off apron a regular basis, they got nothin.  Do it.  This year ,get is off the hook with threats.  That's a sign of poor management.  Call in, don't look back.

lindseyrca -- "the postmaster decided that everyone needs to under threat of putting us on “emergency replacement” ie fired on the spot if we don’t come in. "

-- That is probably Emergency Placement in Off-Duty Status, as found in Section 651.4 of the ELM ( Employee and Labor Relations Manual ).

--  An employee may be placed in an off-duty nonpay status immediately, but remains on the rolls when he or she:

a.  exhibits characteristics of impairment due to alcohol, drugs, or other intoxicant,

b.  fails to observe safety rules

c.  fails to obey a direct order   ( being ordered in on a Sunday would be something of a stretch of a legal order.  Regular carriers are prohibited from working Sundays, unless having volunteered because of the special MOU )

d.  provides reason to be deemed potentially injurious to self or others

e.  disrupts day-to-day postal operations.

Sounds as if your PM is feeling heat from District to get all the parcels out of the office and delivered fro Christmas.

--  Call the already posted phone number for unscheduled absence and get the confirmation number to cover your assets.

"can a RCA really be fired on the spot with no disciplinary history in the 3 years working there."

--  Discipline is supposed to be progressive, so unless an RCA really committed something really, really bad, no.   Even then the union would have to represent that RCA.

--  The threat of being fired if one does not come in on a Sunday could be grounds for a grievance for "bullying" at the very least.  See if the office steward or Area District Representative would agree.

--  Hopefully there are some other employment options in your area.

Not all offices are linked to the 800#. So one has to call the office and put up with Management pressures on the phone to guilt the weak into showing up.

Hard to cite bullying if one is not wise enough to record call.

But what constitutes a direct order?  Is a supervisor saying that the PM said that everyone had to come in a direct order?  As for employment, it’s a 1 day a week job maybe 2 on average and again with no benefits.  As for calling out, it may be legit.  I’ve worked 13 days in a row and have had only 2’days off since the Tuesday after thanksgiving and that was to have a tooth pulled and I got crap for that too

Oh and it has nothing to do with the district but a bully of a PM.  I sometimes get calls at 1:00 in the afternoon telling me he needs me to come in which by that time of day I can’t.  Last year he told one RCA that she couldn’t have off for her own sisters wedding with threats of firing her.  He’s always giving the “you better or else” speeches.  In my 3 years there I’ve called out twice .. once because I was puking she hsving diarrhea and it was the middle of summer and the other was for the tooth which wasn’t really a call out because I told them ahead of time.

I always like to say... if you let them walk on you... they will...  <img title="Confused" alt="Confused" src="https://www.ruralmailtalk.ruralinfo.net/wp-content/sp-resources/forum-smileys/sf-confused.gif" />

Linda, why do you answer the phone at 1:00?    RCA's are not on call ( meaning getting paid to wait around the phone ) and are not required to answer.  If they try to discipline you, a real steward would get you out of it without even an official discussion being on record.

I represented an RCA who answered the phone while on a job 100 miles away. PM gave 7 day suspension.    District Manager of Labor Relations even agreed that there was no reason for issuance..........  he even stated why in the hell did she answer the call and we wouldn't be wasting everyone's time and money on the grievance.  BTW carrier was trying to be nice an thought PM might need an answer to a question about something.

When  I'm scheduled off and not told in advance that I might be needed due to someone being sick for a few days and might not be back or something like that ( vehicle not being ready at shop), I don't pick up the phone and look at the missed call until I'm done with everything I'm planning on doing for that day........      Might even be around noon........   I then call them back  :)

Linseyrca, Are you sure it was your manager? It may have been a crank call by someone who had his phone, or if the post office phone, one of your co-workers calling and acting like your manager. When you get called in for your investigative interview, if your manager takes it that far, first require a steward be present at the last minute before the meeting. If no steward is in your office, this delays your manager's plans again, until a steward can be scheduled to come. When you finally have the interview, make sure you specify you had no idea that your "real" manager would make such a request by phone, since you are a scheduled employee, and a real manager wouldn't go against the contract and change your schedule on anything but a reasonable amount of time, like the contract says. You, therefore, figured it was some co-worker playing a practical joke on you. You, of course, would never refuse an order from your manager that was contractual in nature, safe, and legal. If your (completely pissed off, by now) manager still places you on emergency placement removal, your grievance will be easily won, you will receive back pay for any time you may have missed, and your manager will look like the jerk he is. Sometimes you have to go through a little stress like this (emergency placement, grievance, back pay) before your manager respects, and shows respect to you and others. If you were contemplating  resigning anyway what have you got to lose, except making your manager look like a fool on the way out, but I don't see you receiving any legitimate discipline whatsoever.

It was a text so there’s no real way to say I didn’t know it was her.  What does the contract say regarding schedule changes because last I heard we have to be available to be called in every morning.

Sounds like they've already dumped on your Christmas, and that's sad...

Did you respond to the text???  If not... then here's what I'd say when asked about it...  DOH!?!? that stupid phone of mine... I've been missing all sorts of texts... I don't know what in the world is wrong with the stupid thing... guess I'm gonna have to get it checked out... so, no, I never got your text... DOH!?!?  <img title="Confused" alt="Confused" src="https://www.ruralmailtalk.ruralinfo.net/wp-content/sp-resources/forum-smileys/sf-confused.gif" /><img title="Surprised" alt="Surprised" src="https://www.ruralmailtalk.ruralinfo.net/wp-content/sp-resources/forum-smileys/sf-surprised.gif" /><img title="Embarassed" alt="Embarassed" src="https://www.ruralmailtalk.ruralinfo.net/wp-content/sp-resources/forum-smileys/sf-embarassed.gif" /><img title="Laugh" alt="Laugh" src="https://www.ruralmailtalk.ruralinfo.net/wp-content/sp-resources/forum-smileys/sf-laugh.gif" />

Linseyrca, the things I posted above work well for texts also. If a practical joking co-worker picked up her phone while she was helping at the window, it easily could have been done. In defences to discipline an employee must demonstrate that they never realized the order  (text) was an order. Especially orders that are against the contract would be easily thought to be from someone other than a manager. Rca's are referred to in our contract as scheduled employees. Schedules are usually posted a week in advance, because of the excessive amount of knowledge managers have of postal operations, (sic) they would know when" extra Christmas help" would be needed and the times to schedule them.

Wow.  Did I read that correctly?  You're a RCA; you were scheduled to work on Sunday, the 24th, and you decided you don't want to at 10:30 at night on the 23rd because it's not worth it for a 8-hour a week job?  Maybe you should just quit, because by you not showing up on the 24th is just screwing your fellow RCAs and not management.  Just sayin.......

Um where did you get any of that from?  If you read my post or even just looked at the time stamp you would know 90% of what you said isn’t even true

Exactly what happened to me today. RCA for 2 Years and 1 month. I was off yesterday. By 8:32 am I got a text to report to work. For etiquette side, I replied I have dental appointment. PM then told me that I am required to report to work immediately. Then told me I am to report to work today which in my schedule I am still off. When I reported this morning he give me a Letter of warning and charge that I failed to report to work. He charge me with "Unscheduled absences". He said he talked to Union and that "I as an RCA is on call up to 10:00 in the morning".  Called and emailed Union, no reply yet.

Kj... ALL discipline should be grieved... if you got a LOW, grieve it... your Stew maybe can get it thrown out, or reduced...

Good luck...

kj -- "He charge me with “Unscheduled absences”. He said he talked to Union and that “I as an RCA is on call up to 10:00 in the morning”.  "

--  One way to nip the "on call" situation in the bud is to present green card to the supervisor the next time you are scheduled to work for the hours you sat by the phone, waiting to be called in.

--  Also, politely ask for that "on call" directive to be put in writing.

--  And politely ask to which union rep he spoke with.

--  Contact the union rep and confirm manglement's phone call and union rep's response.

--  If union rep actually agreed with manglement, politely ask for a reference -- and share that reference with us.

--  And might as well buy a t-shirt with a target on the back.
