(RCA) I was on a route 3 days last week and looked at my check and 2 out of the 3 I was given eval so I asked my manager why I wasn’t given eval for all 3 days and she stated since I received parcel help (route is overburdened) it became a split and I no longer qualify for the eval so I was given actual hours worked. I don’t understand because I did all the mail and from my understanding if I do all the mail I should be receiving the full evaluation for the route. Can someone give me some advice/info on how to go about this. Thank you!
Management may "split" a route when there is no leave replacement assigned under the previous 7 forks in the road (see below). Management cannot pick the least costly option then work backwards from their conclusion to satisfy their premise.
When management "splits" a route, they indicate the previous 7 options/conditions were either exhausted or not selected.
"Auxiliary Assistance" isn't analogous to "splitting" a route. The mechanism of "auxiliary assistance" existed
many years before the "split a route" language came into being.
If management wants to claim the route was "split" just because you received auxiliary assistance, consider grieving that management didn't follow the order of consideration.
Hold management to the theory that management split the route and that you should get paid for your 1234 time (green card) for actual hours worked. Then, additionally require evaluated pay for management not properly utilizing the matrix at one of the earlier forks in the order of consideration. Had it not been for the violation, you would have been assigned to the route and no "split" option would have existed.
Management may counterclaim unjust enrichment because the combined total ("split" pay plus "whole evaluation" pay) is more than you would have received, if not for the violation. However, that theory removes the enforceability of those earlier forks. (There is no "right" without a remedy)
If it were the case that you were assigned to the route, but then were directed to "split" a route, you'd get the evaluation plus whatever time associated with the "split". Management is in charge of scheduling, and there is no option for carriers to request management to "split" a route. If there were, there would be a way to jump conditions in the order of consideration. The fact that the route "split" was the same you would have been assigned to is of no consequence.
Don't be surprised though if they tell you to pound sand at the step 1 discussion. You'll probably need to file to get paid.
