RCA and back pay

Question,  if an RCA has been removed for reasons,  and is allowed to come back, where in the contract does it say they get back pay for not working on their primary route while they were gone ?  Say three weeks gone while II was being done and three days back pay for not working the route one time per week on the regulars day off?  Thanks

--  Actually need more details.

--  If the RCA did something ( really bad ) that resulted in an Emergency Placement in Off-Duty Status ( ELM, Section 651.4 ) that is a nonpay status, so back pay would not be involved.

--  Even then, if removed ( fired ) then allowed to come back ( rehired ), the gap in service could be a no-pay situation.  Do you have further info to provide?

I'm not aware of any contract provision such as you're inquiring about, especially for an RCA... but that doesn't mean there might not be something that somebody else is aware of...

I have heard of Regular carriers been put off of work during an investigation, and once they were cleared, they got back pay for all missed work... never heard of it for an RCA, but that doesn't mean it can't happen... I suppose it might depend on the circumstances...

If you've been off for the II (incident investigation??), I'm assuming maybe you have been in contact with a steward about this??  What have they told you regarding any possible missed pay???

Good luck, and glad to hear at least you're back at work...

Thank you for the comments. I am a regular.  One of our RCA's was removed for behavior issues,  and also the PM didn't think the RCA had passed their 90 probation.  union was called by this rca,  made the 90 days by three days,  RCA is coming back with   an agreement for the behavior issues (like last chance)  and union included back pay for the time it took to do the investigation (three weeks,  one day per week) as the RCA would have been working on assigned primary route if not been removed.

According to union, it is somewhere in the contract, (which I have never seen) that RCA's get back pay, if returned to work.    I know regulars who have been removed and come back with no back pay at all,  which I understand is agreed upon in the negotiations,  but I would like to read this back pay thing myself and I  find it interesting the union can't get us a contract that works,  or answer questions for us, or even get back pay for some regulars.  I am not dogging this RCA for the return,  just have never seen it in writing for back pay when removed then reinstated for a day they might not have even been available to work.

Sounds like maybe it varies from one instance to another... I've known of Regulars that got back pay after being off, and you said you know of Regulars that got no back pay... and in this case they gave the RCA a day a week for the time off during the investigation...

So, I'm guessing grievances were filed, and these were the agreements that resulted from the settlements... and I suppose they could be, and maybe should be, different in each circumstance, based upon the situations (which are likely all different)...

jmho...

mollygreen -- "According to union, it [ RCA back pay ]  is somewhere in the contract.

--  Politely ask for the reference.  But probably more likely having to do with the investigation time than the contract -- IMHO.

"One of our RCA’s was removed for behavior issues"

--  Not to be an alarmist, but apparently someone has forgotten about Royal Oak, Michigan or the recent UPS incident!
