A lot on here talk like anyone can get out of working Sunday now. This will only apply to "observant" Christians. Wonder how they will like it when a Seventh Day Adventist needs to be off from sundown Friday to sundown Saturday. Well, that was the argument they were supposed to make the argument in front of the USSC, and the justices found it lacking. But you’re right, they get another bite of the apple.This decision won't do anything, functionally.
It's an incredibly narrow decision that returns the case to lower courts, effectively eliminating the governmental position on de minimus impact. All the USPS needs to do is come back with an argument that accommodation would negatively impact business function beyond the argument of, "yes."
I was ALWAYS oh so very proud of Mr Groff and his "refuse to lose" , "never give up " , "don't listen to those clowns" , etc. attitude. While I myself personally agreed with him and his fundamental Judeo Christian beliefs , it would not have mattered to me WHAT the issue was and / or whether he prevailed or not as I would have been and currently am just as proud of him. While we are screwing around with pretty much meaningless National Step 4s and local office grievances for "too many this or too many that" , Mr. Groff had HIS argument before the highest court in our land. When his coworkers were asking him , " what are you going to do ? " , his response was , " here, hold my scanner." There is NO WAY dog food and diapers and paper plates are even in the SAME CATEGORY of importance as just ONE of the founding beliefs of our Nation. I live and work under the mindset and philosophy of " attack EVERY problem with enthusiasm as if your very survival depended upon it. " That's right, the same passion and relentless pursuit for justice , fairness, equality, etc. goes into the " you owe me an hour pay for cleaning up this mess " as does the " you cannot and will not remove this guy / girl . " One thing most people never realize is that once you are wronged, you really have nothing to lose so why not fight back ? I recall unofficially assisting a carrier that was facing a removal due to an accident. I asked him about his grievance after he received his letter of removal. He said , " why would I grieve it , they are firing me ? " I told him, " well , they can't fire you twice...........you will either prevail and get your job back or you will be no worse off than you are now. " It was like an epiphany to him. He ended up getting his job back. Point being, having a relentless , tenacious and almost militant mindset to achieve your goal can and will guarantee success at any level of litigation. Exactly. And the covid denial opens the door for it to end. No Sunday delivery does not violate the contract. It won't harm the post office because we are salaried AND 77% of us are still UNDER evaluation. Every carrier in the country should be refusing to volunteer, which is what Sunday has always been.We will see
