Tie Breakers

I’m an RCA that was hired in a class of four. Three years later, we’re all still here. I know for tie breakers it’s enter on duty date, total postal time, test score, then SS#. Does the total postal time have to be within a certain time period? One of the guys was a CCA but I don’t know how long ago. The kicker is, he doesn’t even have a test score so when I grieved this a year ago, he would have been last but just last week he says he has prior postal service so he goes from 4 to number 1.

If you read the contract language it will specifically detail the parameters of tie breakers. Prior postal service is not mentioned, total "postal time" is not mentioned, from my recollection. Please post what you determine from reading the contract. It is available on this site.

Twingrlie -- RCA Tiebreakers -- Article 12.2.B.3.b.

- When the "longest period of service" becomes a factor for rural carrier associates, a tie shall be broken by applying the following factors. In each instance, continuous service shall be considered before non-continuous service.

( 1 ) length of service as an RCA employee
( 2 ) length of service as an RCR employee and / or an auxiliary rural carrier
( 3 ) length of service as an Emergency Hire, either as a Designation 74 or a Designation 78 ( as used prior to July 21, 1981 )
( 4 ) length of total prior postal service
( 5 ) exam score
( 6 ) numerical by the last three ( 3 ) or more numbers of an SSN

-- Off hand I'd say ( 4 ) length of total prior service will work in the former CCA's favor -- sorry.

-- Quite possible the former CCA doesn't have an RCA test score but may have one as a city carrier. But should not matter as exam score is used after total prior postal service.

-- Just like a seniority list for regulars, manglement should have one for RCA's -- JMHO, of course.

-- You could ask your Assistant District Representative to look into it, but don't get your hopes up.

-- PS -- congratulations to all 4 for hanging in there for 3+ years.

It may not apply to you , but when I went regular, there was a rca that transferred in from another office, she had more time than me as an rca. I was the senior rca in the office and I got my choice. We went regular on the same day and she got second pick. But once we went regular they put her full time in and she had more seniority than me. It is possible it has changed since then. Was he in your office as a cca?

If he doesn't have a test score he cannot go regular. We had a RCA in that boat (for whatever reason) who refused to test to get one. He never went regular.

We had an RCA whose test score said INELG which meant ineligible because he bombed it and he should have never been called for an interview to beginwith but still bid on a route and converted to regular when he became the successful bidder.

No. He was a CCA before I even started with the PO.

I did consult my DR. He said his total prior postal service stands and therefore he’s higher up.

Reread the contract. See post three.

I'm reading you as having grieved RCA seniority a year ago. What was the outcome?

So I grieved it back in February because no one had our test scores or knew how to retrieve them. After filing the grievance, I was able to obtain 3/4 test scores and confirmed that I was top out of the others. Now, after asking the 4th person for their test score (and him and District being unable to provide it) he informed me that he has prior postal service experience and that should count above a test score. So after settling the grievance in February, it’s come to find out that I am number two and he is number one.

-- You can take some solace in knowing that to the USPS, every employee is just a number.

I’m actually not mad about it. When I grieved it back in the day I just wanted to know where I stood among the rest. If it was 1 or 4, it wasn’t anything I could control. I’m just annoyed that he claims he didn’t care where he stood because he knew he bombed the test and wouldn’t let anyone know his score. Now that he knows the test score doesn’t apply for him, he’s all excited to be number one.

In a dispute about seniority all form 50's need to be checked, along with any "change in service". It is possible to have all been in the same class and a transferred employee to have his paper work delayed later than the start date of others "hired" at the same time. Have you ever seen a pm get paper work done in a timely fashion? It all depends on the change in service date and the form 50 dates. The change in service dates can be checked by an ADR or DR. I have also seen bids go to the wrong carrier due to change in service dates not checked, but reverted after a grievance was filed.

I have all their form 50s. All the dates are the same.

Okay

Okay, call me crazy, but the way I keep reading this ( IN EACH INSTANCE , CONTINUOUS SERVICE SHALL BE CONSIDERED BEFORE NON- CONTINUOUS SERVICE )

1.length of service as RCA employee

So if you have been at your office longer, as an RCA, and the other carrier was not in your office, and transferred in .??‍♀️

I agree with stillfirstclass , you need to go higher up the chain of union reps.

That’s the way it worked for me. The other carrier transferred in ( she worked in another town, different office, she had about a year on me )when we bid on route , I was consider senior, because my time was continuous. As I said before, we went regular same day and she got her time back after going regular.
Now if we bid to change routes, she has more seniority than me.

In our office our boss does have a list of regular and RCAS seniority list. You can see it on bulletin board.

This is not the only case I have seen like this.
We had RCAS, that came to our office knowing they would start at bottom. One super sub, whom we were borrowing, gave up 5 years in old office because of harassment. She said it was worth it. She has gone regular since then and has her 5 years back.

Postal-xam@58 -- I believe the OP mentioned they all have been in the same office for the same length of time.
