Unscheduled absences

kj -- "ADR said I am on call 24×7. "

--  Okay - get a THIRD opinion for the District Representative.

--  If the DR concurs, contact the Director of Steward Operations at NRLCA HQ.   The Director's address is on another thread here at RI.

"After the grievance I'm planning of opting out of the Union "

--  Do your due diligence for that as there is a narrow window to get the paper work to NRLCA HQ.

--  For starters, you'll need SF 1188 ( Cancellation of Payroll Deductions ) -- to whom to send copies is at the bottom of the form, but not the actual addresses.  MAKE COPIES!

ADR knows I get a LOW for this. I haven't had any disciplinary letter this is the first time. Funny thing is I get a LOW for not showing on my day off. LOL. and ADR said I am on call 24x7. LMAO. Hate the first step of the grievance process..... I will meet with PM and if he dont cooperate go back to ADR and let them work. I've already paid them a lot so I need to get at least my moneys worth. After the grievance Im planning of opting out of the Union :(  </blockquote>
I'm sorry about your ADR but he is wrong. There is nowhere in our contract or PO-603 that states we are "on-call" & none of us are paid to drop everything & go to the office at the ring of the telephone! That LOW should be thrown out as discipline is progressive & it starts with a Pre-D so mgmt can determine if the infraction warrants a write-up.

Kj, if you are looking in you file to see if you've gotten a letter of warning, then you didn't get one. A letter of warning is just that, a letter handed to you from your manager that spells out what you did" wrong" and what you are to do to correct it. If you received one, you would know. I'm guessing that you misunderstood your manager.

kj -- "ADR knows I get a LOW for this."

--  Page 36 of the contract - Letter of Warning:  A letter of warning is a discipline notice IN WRITING, identified as an official disciplinary letter of warning which shall INCLUDE an explanation of a deficiency or misconduct to be corrected.

--  Did you get such a letter?  Or told one would be put in your e-file.  Or see such a letter in your e-file?

--  What was explanation of the deficiency or misconduct?

--  Did manglement state how the deficiency or misconduct is to be corrected?  Sitting by your phone 24/7 is not a way -- unless manglement is willing to pay you to do so.

--  Did manglement provide a reference that states RCA's are on call 24/7?

--  The consensus here is this is a minor offense, so has manglement discussed the matter with you - in private?  ( any time one is called to the office for a "discussion", it is a good idea to have another carrier sit in or at least be sitting out side the office in case a "supervisor said - carrier said" situation arises. )

--  Has the ADR mentioned what is happening with your grievance?

--  IMHO -- this has gotten way out of hand.

trashistan -- Being retired does provide some time for research.

--  But to be on the safe side, verify things yourself, as I have goofed a few times.

--  BTW -- nice "handle".

I don’t know, he just is.  It’s downright amazing sometimes.  I have often thought , (or I should say hallucinated), wondering what it would be like if our steward system, labor relations officials, and national board would be like if they were btdret.

Shafted et al -- "Is btdret “bored to death retired?”"

--  Far from it!!

--  Have learned more about the contract, PO-603, and other manuals and hand books than I ever did while working and as such, might as well share it.

--  Plus other non-postal activities keep me quite busy, thank you very much.

Ooo all the letters fit I thought you had it there.

Well your work does a lot of good here, that's for sure.

trashistan -- "Ooo all the letters fit I thought you had it there."

--  Actually "Shafted" left out a "t".  But still a good one.

I vote that the NRLCA hire BtDt... let him give answers here on RI Mail Talk, then he could wander the halls in Arlington, and raise some hail with Jeanette and her lame-o crew about the issues he gets from carriers online...  <img title="Cool" alt="Cool" src="https://www.ruralmailtalk.ruralinfo.net/wp-content/sp-resources/forum-smileys/sf-cool.gif" />

Shafted -- "Oh hell, now I have dyslexia, and dementia hahaha."

--  Just call it the onset of "sometimers".

D.B.Cooper --  Well, I already answer questions here for free ( sort of like delivering Amazon parcels! ).  But I'll have to decline wandering the halls in Arlington.

Yeah, I almost forgot what this thread was originally about... <img title="Surprised" alt="Surprised" src="https://www.ruralmailtalk.ruralinfo.net/wp-content/sp-resources/forum-smileys/sf-surprised.gif" />

Wonder how ole Kj is making out on this deal???  <img title="Confused" alt="Confused" src="https://www.ruralmailtalk.ruralinfo.net/wp-content/sp-resources/forum-smileys/sf-confused.gif" />

<span style="color: #3366ff">-- Yes I did get a letter of warning but I did not see it in my E-file. It wasn't send to HR. Maybe it was only keep on my office folder.</span>

<span style="color: #3366ff">--reason for misconduct is: </span>

<ul>
<li><span style="color: #3366ff">Unacceptable Attendance</span></li>
<li><span style="color: #3366ff">Failure to meet the attendance requirements of your position</span></li>
</ul>
<span style="color: #3366ff">And then it states the employee and labor relations manual--511.41 definition of unscheduled absences. then goes to 665.41 requirement for attendance and 665.42 absence without permission. </span>

<span style="color: #3366ff">All of these allegations are unrelated to me. At the time of absence it was my day off. Also I did talk to PM about the LOW and he told me it is not going away because I still have another one coming; "I lost a cluster box key". (I lost it when we have a heavy snow like 3 weeks ago. We all believe no one outside PO has picked up the keys bc we don't get reports of stolen stuff inside the cbus. We all think I might have dropped it off on one of the tubs and was sent to the truck and it wasn't seen yet. ) I asked PM , what are my consequences for losing the key? PM replied, I may have to pay the expenses for changing all the locks ranging from $1200-$1400. I also brought this topic to Union, and ADR did not answer me on this. </span>

<span style="color: #3366ff">PM is a difficult person, not easy to deal with and he is rude. </span>

<span style="color: #3366ff">One of our clerks who has been working there for 30+ years told me "don't mind about the LOW, he give me a low before too. If it is not in your e-file then don't file a grievance he didn't send it to HR."</span>

<span style="color: #3366ff">So now my questions does PO have a number of days to send that file to HR? Because if he didnt send it before, then he wouldn't have time to send it now. </span>

You didn't get one, if it is not in your file folder, which you may ask to see at any time. You could get one for the loss of an accountable arrow key. Those should be attached to a chain and the end of the chain to one of your belt loops. If the chain system is not being used by your pm, he is partly at fault also. If you have a letter of warning in your file, in the pm's office, you have only 14 days to file a grievance before being untimely.

kj- it does not matter if the LOW is in your on-line file or your in-office file, it still counts. The carrier MUST receive a copy of the LOW & not just "told" that they'll be getting one. One the LOW is rec'd by the carrier, the 14-day clock starts. If a grievance is not filed within that time, the LOW stays for 2 years. Discipline is progressive so the next discipline would be a 7-day paper suspension. This is why you should ALWAYS grieve a LOW.., guilty or not.
