What the Crap?

I'll tell you what my district rep said.

They said they can delay the mail if they want. (I don't know if that's true when there's actually criteria spelled out)

When you Hotline on OIG website it says that you won't find out the results. It says that you should wait 60 days before filing a FOIA request if you want to see what their findings are.

I just figure that this is our only way of having an investigative interview.

Here's part of my letter:

While management has the "right to manage," they do not have the right to intentionally delay mail to manipulate route evaluations or avoid paying overtime. Here is the breakdown of why this is against the rules: The Sanctity of the Mail. According to Handbook PO-603 (the rural carrier’s primary manual) and the ELM (Employee and Labor Relations Manual), all employees—including managers—are required to handle mail to prevent "unauthorized delay."

Willful Delay: Intentionally holding back mail is a federal offense (18 U.S. Code § 1703).
Official Stance: USPS headquarters consistently reminds staff that delaying mail to "save hours" erodes public trust and can lead to administrative action or removal.
Impact on Rural Route Evaluations: The rural craft is unique because pay is based on the evaluated time of the route. This delayed mail is not accounted for on the radar report. The radar report is how rural carriers are paid based on an average of daily mail. When the daily mail exceeds the standard amount because it is multiple days worth of mail, carriers should receive proper compensation to adjust for the mail that is unaccounted for. Because rural carriers are paid based on a "system of averages" (the evaluation), the rules about how mail is handled are much stricter than for city carriers. Any mail left at the case directly affects the data used to calculate your salary.

Proper Procedures for "Left Behind" Mail if mail is legitimately delayed (e.g., it arrived too late from the plant), management must follow specific protocols: PS Form 1571: Any time mail is not delivered on its scheduled day, it must be reported on PS Form 1571 (Undelivered Mail Report). If a manager tells you to leave mail behind but refuses to sign a 1571 or instructs you not to fill one out, they are likely attempting to hide the delay from higher-level reporting systems.
Exceptions
There are a few rare cases where delaying mail is permitted:
Safety: If a bridge is out, there’s an aggressive dog, or weather makes a road impassable.
Acts of God: Fires, floods, or storms that prevent the carrier from completing the route.
Operational Necessity: Occasionally, if a clerk shortage means mail isn't sorted until long after the carrier’s "cut-off time," a postmaster might delay it to the next day—but this must be documented.

18 U.S. Code § 1703 is a federal statute that specifically addresses the "Delay or destruction of mail or newspapers" by USPS employees. It is one of the foundational laws used to ensure the reliability of the U.S. Mail.
Here is a breakdown of what the law says, who it applies to, and what the consequences are:
The Legal Text
The statute is divided into two main parts:
Subsection (a): Focuses on any "Postal Service officer or employee" who unlawfully detains, delays, or opens mail (letters, packages, bags) that was entrusted to them or came into their possession.
Subsection (b): Specifically addresses the delay or destruction of newspapers by an employee, or an employee permitting someone else to do so.
Key Legal Elements
To understand how this applies to a manager delaying a rural route, there are three critical terms:
"Unlawfully": Courts have interpreted this to mean acting without authority or outside of authorized postal procedures. If a manager delays mail to hide poor performance metrics or to manipulate a route count, that is generally considered "unlawful" because no postal regulation authorizes mail delay for those reasons.
"Detains or Delays": This is not just about destroying mail; simply holding it back from its intended delivery schedule is a violation.
"Knowledge": Recent court rulings (like the 10th Circuit) have clarified that the government doesn't necessarily have to prove the manager had a "bad motive" (like stealing). They only need to prove the employee knowingly engaged in conduct that was unauthorized.
Penalties:
Violating 18 U.S.C. § 1703 is a serious matter:
Imprisonment: Conviction can lead to up to one year in federal prison.
Fines: The court can impose significant financial penalties.
Employment: Beyond criminal charges, a violation of this code is almost always grounds for immediate removal (firing) from the Postal Service.
Why it Matters for Rural Carriers
If a postmaster or member of management tells a carrier to leave "raw mail" or "parcels" or "DPS" or "flats" behind because they don't want to pay overtime, they are potentially stepping into § 1703 territory. While management often claims "operational necessity," they are legally required to report delayed mail.
My PM is taking the easy way out. He is lying now and saying that he did not tell us to hold back letter mail. I was told by him to take only anything that requires a scan. How do you win when you are dealing with a habitual liar!

What did the Postal Inspector say?

What did your union DR say? (not just that it's illegal, what are THEY going to do about it?)

Your Congress representative (House) in their home office has a person dedicated to things like the post office, IRS, etc that are federal jurisdictions. I believe you can contact their office and ask for anonymity due to threat of retaliation, etc. Your customers can surely call your Representative.
I haven't heard from any of the above. The PM is lying now and saying he didn't give such an order . The PM lied to my union DR as well. Would like to get his butt hooked up to a polygraph! Then we could hang him to the highest tree!!!

So... even the mothership USPS.... is saying there's delays, and basically, suck it up buttercup... Fugetaboutit all that neither snow ❄️, nor sleet, nor fog of night nonsense.... thing of the past.... 🤔 🤷‍♂️👉(n)💩😵‍💫🤣
But the delay was not weather related. The PM had the dps hidden in backrooms. We delivered packages every single day on those snowy roads. That is why my customers are so upset. I delivered their parcels but not their mail.

both of them should help deliver packages. did PM went home at 1pm and call it a day? and just let the stupEDvisor do the dirty work?
The PM hid in his office while the supervisor gave us his command of taking only packages. I knew he was sitting here up for the fall. She is now leaving our office. Wish I could go with her

Right......................like EVERY carrier in the office is lying. One of the reasons he is in a panic is because he DID NOT report the delayed mail. Now, he is trying to cover up a lie with ANOTHER lie. Had he reported delayed mail, there would be no internal USPS issue. Sure, there may have been a few streets or homes that could not be serviced due to weather but even THAT mail brought back is supposed to be identified when left at or in the case as to WHY it was NOT delivered. Now that the story is out on your PM, that sound he is hearing is the thin ice beneath him giving way.

I think they are and/or were using the weather as an excuse to delay the mail and not deliver the mail. The mothership knows when it's not being delivered, with all their tracking and so forth.... many days I would get an informed delivery email saying I was to received several mail pieces, and I would get nothing on some of those days... I also typically get one of those emails that say "your mail has been delivered" after the mail runs... and on those days when I didn't get any mail, I never got the email saying my mail was delivered... So, my point is, they know when mail is not being delivered... they even have some little silly program that generates NDI's non-delivery indicators, that lets them know when stops are skipped when they know that address is supposed to be getting mail... so, they know... if you skipped a bunch of boxes, when you were supposed to be stopping, they'd be on you about it... but when they decide to do it, it's all good... 🤔🤷‍♂️👉🤫

If the Postal Inspector gets involved they'll interview other carriers, personnel to determine fact and truth. Your Congressperson's office understands that management often lies is what I'd bet. Pressure from someone, maybe more than one side. might make someone crack. Best of luck

Funny thing that you mentioned thin ice. I have filed quiet a few grievances on him this week and he called me into his office with one of his pet minions and he declared that I was on thin ice after he talked to my " boss". Sorry, I don't kiss butt and I have never been job scared! Let him fire me, make my day!!!!Then he started screaming at me so loudly that the clerk from our lobby had to tell him that customers were concerned . Yes, this clerk is my witness now and yes I filed yet another grievance for workplace harrassement. How many grievances does it take before upper management notices? We are all concerned about our safety at this point.

I haven't heard a word from anyone since I filed with the OIG.Just crickets..

I actually believe every aspect of this place is solely controlled by the Devil himself and Demons are placed in management positions. It is now down to Good verses Evil

Management is SUPPOSED to report delayed mail. That is ONE of the reasons we are SUPPOSED to get permission to leave mail. You know, take one set of car ads and leave the OTHER one for tomorrow and situations of that nature. There's a real good possibility that the mail in your office that was delayed was not reported. I'm not saying it wasn't reported but I have serious doubts. Also, delivering parcels only. even for ONE day, can really impact route evaluations in a negative manner. Then there is the cumulative effect , depending upon the number of days of delayed mail , of numerous days of mail attempting to be delivered in ONE day. There is this ;

ARTICLE 5
PROHIBITION OF UNILATERAL ACTION
The Employer will not take any actions affecting wages, hours
and other terms and conditions of employment as defined in
Section 8(d) of the National Labor Relations Act which violate
the terms of this Agreement or are otherwise inconsistent with
its obligations under law

And since we are actually performing a "mail count" each and every day, there is this ( attached ).
My DR in the union was bold enough.to tell me that a couple of days of not delivering any mail will not hurt a thing! Just WOW!!

Not sure what state you're in, but if your DR isn't helping and not following the post office rules, call your state President. Ask for help. If you get brushed off try Nicki Phillips who's NRLCA national head of steward operations. You can also call the Department of Labor, the toll free national number routes you to an office close to you when you first call in. I've called them several times regarding FLMA and they're very helpful . If they're not the right place they'll give you a referral to the appropriate agency that helps.

Im a former corporate executive, and both customers and subordinates had no issues going up the chain of command if they weren't satisfied.

I hope with every event, every conversation you're documenting it with notes. This not only helps clarify memory but it provides anyone who is making a decision regarding this situation awareness that you have specific detail recorded at the time of the event. Documentation most often wins.
